  • malpractice cases and disciplinary cases based upon inappropriate use;
  • monetary damages which may result from use of social media;
  • dangers of spoliation of evidence by modifying websites; and necessary instructions to clients concerning modifying social media history;
  • how inappropriate use destroys the attorney client privilege;
  • ethical conduct concerning jurors and "false friending;"
  • ABA Ethics 20/20 and new Rule 1.1 requiring technical competency;
  • whether lawyer blogs constitute advertising;
  • developing case-law on "the duty to google;"
  • lawyers' danger of breaching ethical and fiduciary duty online;
  • And a survey of opinions issued by various bar associations.
