Topic: Several important distinctions exist between patent preparation and prosecution practice before the European Patent Office (EPO), and practice before the United States Patent & Trademark Office (USPTO).
This CLE provides an overview and analysis of such distinctions between the EPO and USPTO significant to U.S. practitioners, including exploration and discussion of:
- Internal structure of a patent application as seen by the European Patent Office (EPO);
- Problems of ?intermediate generalization? when amending claims before the EPO;
- Potential risks associated with claim features and specification support at the EPO; and
- Status of Unified Patent Court and Unitary Patent System.
Attendees will gain a greater understanding of EPO patent practice, along with drafting strategies for increasing successful prosecution outcomes before the EPO.
