Topic: It is the policy of the courts to encourage settlement agreements. However, these agreements can be problematic. Proposed settlements have been rejected by the Court of Common Pleas of Montgomery County. Considerations are both substantive and procedural, implicating issues of jurisdiction, due process and notice.
