How an Environmental Phase 1 Can and Can't Protect Secured Creditors and Purchasers

Friday, May 31, 2019
12:00 pm - 1:30 pm

Location: 1/2 CLE Room

Credits: 1.0 Hour Substantive

Moderator(s): Kevin Birkhead, Steve Hladik

Speaker(s): Paul M. Schmidt, Esq.

Topic: Many lenders, equity funds, and other creditors, as well as real estate purchasers, obtain Phase 1 Environmental Site Assessments without fully understanding what protections they do and don't get from it, what prerequisites must be satisfied, and what other tools can be used to address risks remaining after conditions are identified in a Phase 1 report. This CLE explains those issues, and also provides practical tips for how best to employ environmental consultants to maximize the benefits and protections of a Phase 1.
